However, it would be very surprising to know that the real estate agents do not know much about this. As a result, they will not be able give the homeowners any helpful information.
The reason for this is that, the real estate licensing classes do not go in much detail regarding the foreclosure issues. The real estate agents may get very few opportunities to know about foreclosure process after getting the license. However, it is not necessary that they will get such opportunities. In such classes, no discussions regarding the foreclosures are made. Discussions in the sense how to qualify for a foreclosure loan, how to write a convincing hardship letter, how to succeed in postponing the sheriff’s sale, how to get extra time to save the property, etc.
The process carried out in foreclosure depends upon the laws followed by the state. So the homeowners facing such situation should first of all check out those laws. This would give the homeowners a wide outlook regarding such processes rather than going to the real estate agents for help. The proceedings carried out by the lender and the court systems are of different ways. These proceedings include public reporting period, potential redemption period, etc. Thus, it is very essential for the homeowners to know about the state laws. Then only they will be able to know how much time they will get or what other possible and cheaper alternatives are there to come out of the situation.
There are some of the states where the homeowners can be sued after foreclosure if their properties are sold off at sheriff’s sale. This is known as deficiency judgment. This is not allowed in all the states in all circumstances. Moreover, it is very essential to have the knowledge regarding the foreclosure laws regarding this issue. Otherwise, the lender may be able to sue the victims of foreclosure for the difference and hence can achieve a deficiency judgment.
