Foreclosures: A Judges Point a View

When a foreclosure has taken place, the judge orders for a  lawsuit to be sent  to you in the mail.  It is the lender who has filed against you for non-payment of your mortgage, therefore all parties must meet in the courthouse to discuss the matter and the judge renders a solution and/or decision in this case.  The judge is known as the 3rd party person that settles the case.

The judge will hear the case from both parties and decides who is guilty or innocent.  It gets tough when the homeowners does not show, then the judge finds favor of the banks.  So it is in best interest of the homeowners to appear in court and defend themselves.  Although the judge does not mind  rendering a decision in favor of the banks and will order a sheriff to go out and take a lien on the home and take possession and then a eviction is filed against the homeowners.

It is in the best interest for the homeowners to show up due to it will be their only chance to be heard regarding the reason for non-payment of their rental mortgage payment. The judge then hears the side of the homeowners and determine if the story is legitimate and real and if sufficient proof is found or not found the judge basis his judgment on the evidence that is present. If the homeowners can show proof of sufficient income stability and can pay the money in time, then everything may be canceled.

In some cases  the judge will  rendering the homeowners time to pay the rent or to move and they must honor that , if they fail to meet the judges decision then judgment is ruled in favor of the plaintiff which is the bank and eviction charges will go through and  lien will be taken on the home, and he homeowners would have to vacate the property immediately.

The judge can also handle bankruptcy’s to stop the foreclosures, if the homeowners is willing to use that option.  It is not a good idea to ignore the court hearing, because the judge will find  favor of the banks and lenders.

This is a good way out for the homeowners to save their home and work on proving their case.  The homeowners must follow the  judges order and they will be back on track.  The banks and lenders will work with the judge to help the homeowner make good on their mortgage.  If there are no one present to go against their actions, then the judge will accept them and the procedures will begin working with the homeowner, to make good on their home.

As long as the homeowners are aware of the payments that is owed they can begin working on a solution to catch up with their mortgage payments to keep their home.   Most homeowners will take the chance and sell the home before they get in deeper debt with the home.
