One of the beneficial traits of real estate business dealings is the purchase and selling of foreclosed properties; nonetheless this is not a happy occasion. Who ever embarks in it has to deal with a lot of problematic situations such as the stress levels that it causes on those who were once the owners of the house who will feel anguish, anger and frustration of seeing their home being repossessed and sold again.

However, despite this problematic and traumatic experience to both the homeowner and the new buyer, it is still part of the American Dream lifestyle; the ideal of the average middle-class family is to have a home. While for some families the purchase of a house will be without any special or extraordinary events, they will apply for a loan and after a while, they will finish paying it. For others it is a bumpy ride since their household economy will not sustain the payment of the mortgage loan for the duration of the life spam of the loan itself, consequently, they will be vacated and the home will be foreclosed.

Such a terrible event that will indeed cause the damage of the credit score of the delinquent homeowner will be the opportunity of other families that have the same dream but do not have the same financial resources or the alternative to apply for a mortgage loan that will suffice.

In a deeper analysis of the foreclosure market, it has to be said that it is a great opportunity for the buyer who wants to start or enhance their investing portfolio because these real estate properties can be purchased for a lower cost than the average commercial price of the real estate property. Once the real estate property is bought, it can be sold for the full price or it can be repaired and then sold for a bigger price with a healthy gain margin, it is important to remember that most of the foreclosed properties are sold “as is”. This means that if there is the need to repair, fix or adjust anything, it will be the sole responsibility of the new owner while the lending company who is now selling it will not pay for any repair or modification.

Before plunging yourself into the opportunity of investments it is important that you know and research the states of foreclosures that are known in real estate business.

•	Pre-foreclosures:

In this case, the current homeowner realizes that he cannot longer pay the mortgage loan, so he/she will seek someone who is interested in buying the home. During this time, the current homeowner will reach an agreement with the interested party, the real estate property may be transferred to the buyer and the benefit is that the credit score of the current homeowner will not be as damaged as it would be in a complete or total foreclosure.

•	Post-Foreclosure:

In this stage, the real estate property has been sold in open auction and it was awarded to the highest bidder. Nonetheless, it is during this time that the vacated homeowner can request a redemption action, in this action, the foreclosed property will be returned to him/her if some specifications are met.

Arizona agents of real estate are sounding alarms over recent enactments of state laws which set brand new limits for longstanding protections for several owners of homes that are foreclosed

Arizona agents of real estate are sounding alarms over recent enactments of state laws which set brand new limits for longstanding protections for several owners of homes that are foreclosed, saying the legislation might weaken the protection of borrowers and ruin the struggling market of housing.

The realtors’ association of Arizona wants the governor to add subjects of repealing or changing the brand new law to a special law session that is ongoing on the budget of the state.

The issue right now would be changes to state laws which in general currently don’t allow lenders to foreclose on home mortgages in order to recover the overall balance of what lenders owe if sales of foreclosure do not produce the entire amount.

While several states come with laws that go against alleged deficiency judgments that date way back, the law of Arizona was enacted in the year 1971. It intends to protect every consumer from overall financial ruin.
Changes that haven’t taken full effect yet impose brand new requirements of eligibility in order to qualify for the protection against deficiency judgments. One would be that borrowers probably have lived within these properties for six full months, one after the other.

The law of Arizona was completely approved by legislature at the actual urge of the banking industry of the state, which stated that the law of anti-deficiency was abused by builders and investors, along with several that try to attempt the recoveries of lenders by temporarily living within foreclosed homes.
Investors need to be held responsible for all of their obligations, as well as forcing lenders to actually swallow the losses of investors, which actually hurt both the served communities and its lenders. It simply was too easy for these people to give the keys away and walk off. If the home was bought by the person who lived inside of the home, they would not have to worry about this.

But the realtors’ group of the state stated that the law goes much further compared to just targeting ’spec builders. The changes, for instance, would roll back the foreclosure protection that involves second homes, as well as homes that owners who allow relative to live with them.

As a result, more people can file for protection of bankruptcy in order to get rid of their debts in case banks do not work along with them in order to stay away from foreclosures. This would spell trouble for an industry of housing that is attempting to recover within markets that are burdened by extremely high rates of foreclosure. It does not go well for the recovery of the economy.

The changes in Arizona seem to be departures from the majority of the law consideration of other states on issues of foreclosure. The majority of deals on legislation with topics like mediation processes, notice requirements, and help for borrowers.

Times already happen to be difficult as it is. It could help your neighborhood banker; however, it would not be in the complete interest of the economy of the state to keep going.

Due to the current financial crisis of the world most people have mortgaged their properties to the banks or financial institutes and they are facing to a risk of losing their properties do to the foreclosures. Anyway, they are always trying to make arrangements to pay back these mortgages to banks as they want to keep their homes or properties with themselves accordingly. However according to the researched made on the same, it has clearly showed that most people have lost their homes due to this foreclosure situation and most of them have been sold at a very low price accordingly.

Anyway as per the records, thousands of New York families have lost their foreclosed homes due to this situation and the foreclosure bill has brought in to the law. And the government also turning their back on these families and it the worst position on the scenario as these families are helpless on this point. So the Politicians must act on this immediately as now this has been a major problem of the community.

Also the situation is same as with the California and the government should act on this immediately. Otherwise it will make a massive disaster to the society. Anyway the respective parties are always looking for better options to keep the condition under controlled in their states. In order to do this process, they have made several proposals which are not finalized at the moment. Anyhow, they are hoping to get them finalized shortly as controlling this foreclosure bill is a must to keep the flaw of the society accordingly.

Mainly these plans include with write off some of the old foreclosure funds and it will be a good chance to the people who are in trouble with this foreclosure bill. Also they are suggesting reworking on these existing loans which is really good for both lender and the property owner. However the decision is currently on hold and if this is finalized shortly, then it will be a good chance to both parties to solve this foreclosure matter in a very short time.

However the government needs to step in to the scene on urgent basis as if it is not this foreclosure will be a massive problem in the society. Therefore currently the relevant parties have made the necessary arrangements to get the support of government accordingly. However the foreclosure owners always looking for better options for them to keep their business under control.

Anyway, if the current proposals get approved by respective parties, then both parties will have to work on a mutual understanding for a short time till the process operates properly. During this time both parties have to stay control and they need to work according to the process & it will give good results for both parties accordingly. Also this will be a good chance to the people who are willing to reorganize their loans & mortgages which they currently having problems while paying them back.
